Terms of Service
These terms are an agreement between you and Bamboo Forest ("we", "us") covering your use of the Munch app and related services ("Munch"). By creating an account or using Munch, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Munch.
Not medical advice. Munch gives automated, approximate nutrition estimates and research-based insights for general information and personal tracking. It is not a medical device and does not diagnose, treat or prevent any condition. Estimates can be wrong, especially for portion sizes, hidden ingredients and allergens. Do not rely on Munch for allergy safety, managing a medical condition (such as diabetes or an eating disorder), or medication dosing. Talk to a qualified health professional before changing your diet.
1. Who can use Munch
You must be at least 13 years old to use Munch. If you live somewhere that sets a higher minimum age for using online services without parental consent (for example 16 in some EEA countries), you must be at least that age, or have your parent or guardian's permission. If you are under the age of majority where you live, your parent or guardian must agree to these terms on your behalf.
2. Your account
Your Munch account is shared with our sibling app, Flex; these terms apply to your use of Munch. Keep your sign-in details secure and tell us if you think someone else has accessed your account. You are responsible for activity on your account. You can delete your account at any time in the app (Profile → Delete account) or as described on our account deletion page. Deleting your account deletes your data in both Munch and Flex.
3. Your content
You keep ownership of the photos, descriptions, answers and other content you add to Munch ("your content"). You give us a worldwide, non-exclusive, royalty-free licence to host, store, process, and display your content as needed to operate and improve Munch, including to evaluate, develop and train the models and features that power it, as described in the Privacy Policy. This licence ends when your content is deleted, except for residual copies in backups for the period described in the Privacy Policy.
You confirm you have the right to upload your content, and that it doesn't include other people's personal information without their permission.
4. AI-generated estimates and insights
Munch uses AI models and web searches to identify foods, estimate nutrition, interpret your goals and write insights. Outputs are generated automatically and may be incomplete or inaccurate. Insights summarise published research and link to their sources; they are information, not medical advice or instructions. Please review and correct estimates as needed. We don't guarantee the accuracy of any estimate, insight or note, or of the sources an insight links to.
5. Subscriptions
- Plans. Munch requires a paid subscription, offered monthly or yearly. The price is shown in the app and in the App Store or Google Play before you buy.
- Free trial. Eligible new subscribers get a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription and you're charged at the start of the paid period.
- Auto-renewal. Subscriptions renew automatically at the end of each period at the then-current price, and your App Store or Google Play account is charged within 24 hours before the period ends, unless you cancel at least 24 hours before renewal.
- Cancelling. Manage or cancel your subscription in your App Store or Google Play subscription settings (Munch's Profile → Subscription links there). Cancelling stops future renewals; you keep access until the end of the current period. Deleting the app or your account does not cancel a subscription on its own.
- Payment and refunds. Apple or Google processes payment and handles refunds under their own policies. We can't issue refunds directly.
- Price changes. If the price changes, you'll be told in advance as the App Store or Google Play requires, and you can cancel before the new price applies.
6. Acceptable use
Don't use Munch to:
- break the law or infringe anyone's rights;
- upload content that is illegal, sexually explicit, hateful, harassing, or unrelated to food and drink tracking;
- access another person's account or data without permission;
- interfere with, overload, reverse engineer, or scrape the service, or get around its limits or security; or
- use Munch to build a competing product or to train AI models.
We may suspend or close accounts that break these rules.
7. Our service
We own Munch, its software, design and brand. We give you a personal, non-transferable, revocable licence to use the app for your own non-commercial use under these terms. We may change, add or remove features, and we may stop offering Munch; if we do, we'll give reasonable notice where we can so you can request a copy of your data.
8. App stores
If you downloaded Munch from the Apple App Store or Google Play, you also agree to that store's terms, including its terms for purchases. Apple and Google are not parties to these terms and are not responsible for Munch or its support. If you downloaded Munch from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
9. Disclaimers
Munch is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that Munch will be uninterrupted or error-free.
10. Limitation of liability
To the fullest extent allowed by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, health outcomes or decisions made based on estimates in Munch. Our total liability for any claim relating to Munch is limited to the greater of the amount you paid us in the 12 months before the claim or USD $50. Some places don't allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.
11. Indemnity
To the extent allowed by law, you agree to cover our reasonable costs from claims caused by your misuse of Munch or your breach of these terms.
12. Ending these terms
You can stop using Munch and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if we have to for legal reasons. Sections that by their nature should survive (such as disclaimers, limitation of liability and governing law) will continue after these terms end.
13. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Disputes will be handled by the courts located there, unless the law where you live gives you the right to bring a claim in your local courts.
14. Changes
We may update these terms. We'll change the effective date above, and if the changes are significant we'll tell you in the app or by email before they take effect. If you keep using Munch after changes take effect, you accept the updated terms.
